Construction Accident and Labor Law Information

In New York State, we have a statute that provides special legal protection to construction workers while working at an elevated height.  This statute is referred to as New York’s Labor Law.

New York’s Labor Law, also know as “Scaffold Law”, puts responsibility on project owners, general contractors, managers and other responsible parties to ensure a safe working environment.

Two reasons for this law are (1) serious and catastrophic injuries often result from elevated falls, and (2) construction workers rely on a third-party (general contractors, managers, etc.) to make sure the elevated work location is safe. (more…)

Cellino & Barnes College Scholarship Program

Cellino & Barnes will begin accepting applications for our 2011 College Scholarship Program on February 1, 2011.
 
This scholarship fund awards $1,000 to 100 deserving students who live in the 20 counties surrounding Western New York. Since the College Scholarship Program began in 2004, Cellino & Barnes has awarded over $700,000 to area high school seniors.

Darvon Recall – Darvocet Recall

The FDA has issued a recall on Darvon and Darvocet after determining that all painkillers that contain propoxyphene create an unreasonable risk to consumers.

The FDA has also informed the generic manufacturers of propoxyphene and requested that they voluntarily remove their products as well.

Health care professionals have been asked to stop prescribing propoxyphene to their patients, and patients who are currently taking the drug are asked to contact their doctor as soon as possible to discuss switching to another pain management therapy.

Darvocet Side Effects

The following types of serious, life-threatening side effects have occurred:|

  • Heart Attack
  • Cardiac Arrest
  • Sudden Death
  • Stroke
  • Heart Failure
  • Heart Rhythm Distrurbance
  • Arrhythmia
  • Slow Heart Beat
  • Bracycardia
  • Convulsions
  • Overdose
  • Addiction

Personal Injury and Social Media

Do you actively participate in social networking? Do you Tweet or post updates on Facebook?

If the answer is yes and you have a personal injury case, our advice is that you either limit your involvement or stop it all together.

Recently, a New York State Supreme Court ruled that a woman had to release her private Facebook and MySpace accounts to defense counsel. The purpose was to challenge her injury claims.

This ruling has increased the need for an injury victim to be cautious in what they say and post on social networking sites.

You also need to understand that even if you have privacy settings turned on, attorneys are still permitted, through discovery, to obtain your information. You may think that deleting your posts and photos will solve the problem, but it often looks as though you are trying to hide something.

Advice to Personal Injury Victims

As a personal injury firm, we strongly recommend you think before you post. This holds true regardless of whether you are an accident victim or not. If you don’t want something to come back to bite you, then don’t post it.

Defense counsel will not hold back when trying to harm the reputation of a personal injury victim. What should you do?

  • Hire an experienced personal injury firm with a record of success against the insurance industry.
  • Avoid talking or writing about your case with anyone, except your personal injury attorney.

  • Anything you post online can be used to discredit your case. This includes Facebook, My Space, Twitter, online forums and other social media sites.
